Terms of Service

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the pelvicfixphysio.com website (the “Service”) operated by Pelvic Fix Physiotherapy (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

Online Bookings

When you create an online booking with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your booking on our Service. Please note secure credit card capture via our practice management software, Halaxy, is required for online bookings (and some additional services such as equipment hire agreements). Consent to Release Information 

You must acknowledge that an essential part of your care is that your therapist may communicate with relevant professionals in your healthcare team. It must be understood that Medicare requires the treating therapist to communicate with the referring GP regarding the patient's presentation and relevant treatment when attending Physiotherapy on a Medicare referral, or “Care Plan”. Please speak to our reception or your treating clinician should you have any concerns about communication to your care team. 

 

Consent to Treatment 

You hereby request and give consent to our therapists to perform necessary examinations, manipulations, therapy, rehabilitation and medical diagnostic procedures in accordance with their professional training and understanding of your injury. You understand that you have an opportunity to discuss with your therapist the nature and purpose of your physiotherapy care before any treatment is rendered. If you choose not to participate you must inform your therapist immediately.

 

Correspondence

You understand that text & email correspondence (appointment reminders, invoices, general communication) will be sent to the mobile and/or email address you have provided. If you do not wish to receive this communication, you must inform our reception.

Cancellation & Rescheduling Policy

It is expected that if you are unable to attend an appointment with us, that notice is given as soon as possible via phone. If less than two clear business days' notice is given, the late cancellation fee will be 50% of the service price. If less than one clear business day's notice is given, the full fee is payable. If the appointment is able to be filled from the cancellation list, then no fee applies.
 

To clarify the purpose of our cancellation policy:

•  When a client cancels a session at very short notice or just doesn’t attend, it means that somebody else needing help with symptoms has missed out on an opportunity to receive our assistance.

• Cancellation fees are not charged when the appointment is refilled. Hence, by giving us sufficient notice it allows us to consult our waiting list and offer another client the opportunity to attend. As we are not an acute care service, late cancellation spots can be very challenging for our team to fill. 

• Therapy can be a difficult process. Applying cancellation fees is one way to support clients in upholding their commitment to therapy and ultimately improving their symptoms and quality of life.

• Charging cancellation fees is industry standard. This helps our small business to be sustainable to support our community, and ensures respect for and appropriate remuneration of our staff for their time and expertise.

Accounts & Billing 

Please refer to our most recent fee schedule for an outline of the services we offer and associated prices. It is expected that all outstanding invoices will be paid at the time of your appointment. Some services (including online bookings and equipment hire) will require credit card details to be securely kept on file via our practice management software, Halaxy. We accept EFTPOS payment and offer electronic rebates via Tyro/HICAPS (excluding private health claims in Biloela) for your convenience. Payment in advance must be made for telehealth & offsite appointments, including our Biloela clinic. Private Health Insurance & Medicare rebates can only be claimed after the service has been received. In the instance of purchasing treatment packages (such as classes/group programs), paid invoices to claim private health rebates will only be available once the treatment service has been completed. A claim cannot be made on a non-attended appointment.

 

There are strictly no refunds on any services, packages or healthcare products. However, replacement products or credits may be offered.

 

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Pelvic Fix Physiotherapy and its licensors.

 

Links To Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Pelvic Fix Physiotherapy. We assume no responsibility for the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that Pelvic Fix Physiotherapy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

 

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

 

Privacy Policy 

We are committed to protecting your privacy and this information is only disclosed to other members of your care team where necessary. We strongly encourage you to take the time to read the Pelvic Fix Physiotherapy Privacy Policy in full. 

 

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

 

Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

 

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
